1. Services Provided
SOUTHERN MAINE ROLL-OFF agrees to provide the Customer with one (1) dumpster as requested (the “Dumpster”) for the initial rental period as defined herein. Upon conclusion of the rental period, SOUTHERN MAINE ROLL-OFF will pick up the Dumpster and dispose of its contents at an approved waste management facility.
2. Initial Rental Period
The initial rental period begins on the date of delivery and lasts seven (7) days. Additional rental days begin on the eighth day.
- If the Customer wishes to extend the rental, they must contact SOUTHERN MAINE ROLL-OFF at least 72 hours prior to the scheduled pickup.
- Additional days are billed at $15.00 per day, payable in advance by credit card.
- Rental extensions cannot be arranged on the day of pickup. Leaving a voicemail is not considered sufficient notice.
3. Customer Obligations
The Customer must direct SOUTHERN MAINE ROLL-OFF staff where to place the Dumpster on the Customer’s property and is responsible for ensuring the location is suitable. The Customer may load the Dumpster with Allowed Materials (defined below), not to exceed:
- Four (4) tons in weight, and
- The height of the Dumpster’s side walls (no overfilling).
4. Allowed Materials
The Customer may deposit household and similar materials into the Dumpster. Prohibited items include, but are not limited to:
- Infectious waste
- Radioactive, volatile, corrosive, flammable, explosive, biomedical, or hazardous materials
- Any waste regulated by local, state, or federal law
The Customer warrants compliance with all disposal laws and agrees to pay all costs, fines, and damages associated with depositing prohibited materials.
5. Southern Maine Roll-off Warranties
SOUTHERN MAINE ROLL-OFF warrants that it:
- Will manage waste safely and lawfully.
- Will use licensed and permitted disposal facilities.

6. Customer Breaches And Remedies
Customer breaches include, but are not limited to:
- Unauthorized placement of the Dumpster
- Blocking pickup
- Depositing prohibited materials
- Nonpayment of fees
- Violation of any terms of this Agreement
Remedies include:
- Recovery of all owed fees, fines, and legal costs
- Immediate retrieval of the Dumpster
- Pursuit of damages permitted by law
7. Additional Fees
The Customer may be charged for:
- Dumpster relocation on the property: $175.00
- Extension beyond initial rental: $15.00 per day
- Overweight loads: An additional Dumpster may be required at $650.00
- Mileage beyond 40 miles from Steep Falls, ME: $5.50 per mile (each way)
- Blocked pickup fee: $100.00, plus $50.00 per hour wait time (1-hour minimum)
- Dumpster swap-out for a new empty unit: full rental rate applies
The Customer is responsible for any disposal facility surcharges for restricted or special waste items.
8. Cancellation Policy
If the Customer cancels after payment is made, a 95% refund will be issued.
9. Inspection And Rejection Of Waste
SOUTHERN MAINE ROLL-OFF may inspect and weigh the contents.
If the contents exceed four (4) tons, the Customer must:
- Unload excess weight, or
- Rent an additional Dumpster at additional cost.
If prohibited waste is found, SOUTHERN MAINE ROLL-OFF may reject it and require the Customer to remove it at their expense, plus indemnify
SOUTHERN MAINE ROLL-OFF for any damages or costs.
10. License To Enter
The Customer grants SOUTHERN MAINE ROLL-OFF the right to enter the property to deliver, service, or retrieve the Dumpster.
SOUTHERN MAINE ROLL-OFF is not responsible for property damage due to necessary vehicle and Dumpster placement.
11. Equipment
All equipment remains the property of SOUTHERN MAINE ROLL-OFF.
The Customer is responsible for any loss, damage, misuse, or unauthorized relocation.
12. Indemnification
Each party agrees to indemnify, defend, and hold harmless the other from any liability caused by their own negligence, breach, or misconduct,
except where prohibited waste is involved.
13. Uncontrollable Circumstances
Neither party is liable for delays caused by events beyond their control, including natural disasters, strikes, regulatory changes, or material
shortages.
14. Entire Agreement
This Agreement constitutes the full agreement between the parties and supersedes all prior discussions and agreements.
15. Termination; Liquidated Damages
Southern Maine Roll-Off may terminate this Agreement immediately upon the Customer’s breach.
The Customer remains liable for all outstanding charges and damages.
16. Miscellaneous
- This Agreement binds and benefits successors and assigns.
- The prevailing party in a dispute may recover reasonable attorney’s fees and court costs.
- Maine law governs this Agreement; disputes shall be resolved in Cumberland County, Maine.
- If any provision is found invalid, the remaining terms remain in full force.
